Fortnite Gift Card Terms & Conditions
Fortnite Gift Card Terms & Conditions
These Fortnite Gift Card Terms & Conditions (the “Gift Card Terms”) are an agreement between you and Epic (defined below) for your use of a Fortnite gift card (the “Gift Card”) with the prepaid balance service associated with your Epic Games account (the “Epic Account Balance”).
Before you purchase, redeem, or accept a Gift Card, please read these Gift Card Terms. These Gift Card Terms also incorporate our Epic Games Terms of Service at https://www.epicgames.com/tos (the “Epic TOS”), which include the terms governing your Epic Games account and (for residents outside the European Union) a binding arbitration clause and class action waiver that affects your rights about how to resolve any dispute with Epic. If you purchase, redeem, or accept a Gift Card, you will be bound by these Gift Card Terms. IMPORTANT: THE EPIC TOS CONTAIN AN ARBITRATION AND CLASS-ACTION WAIVER PROVISION THAT REQUIRES YOU AND EPIC TO RESOLVE DISPUTES IN BINDING, INDIVIDUAL ARBITRATION AND TO GIVE UP THE RIGHT TO GO TO COURT INDIVIDUALLY OR AS PART OF A CLASS ACTION. BY ENTERING INTO THESE GIFT CARD TERMS, YOU AND EPIC AGREE TO RESOLVE DISPUTES ARISING UNDER THESE GIFT CARD TERMS IN BINDING, INDIVIDUAL ARBITRATION, AS EXPLAINED IN THE EPIC TOS. THE ARBITRATION AND CLASS-ACTION WAIVER PROVISION DOES NOT APPLY TO YOU IF YOU LIVE IN THE EUROPEAN UNION.
In these Gift Card Terms, “we”, “our”, “us” or “Epic” means: (a) if you reside in the United States, Epic Games, Inc. (address: Box 254, 2474 Walnut Street, Cary, North Carolina, 27518, U.S.A.), or (b) if you reside outside of the United States, Epic Games Commerce GmbH (address: Platz 10, 6039 Root D4, Switzerland) together with its affiliates.
About the Gift Cards
In order to redeem a Gift Card, you will need access to the internet, you must have an Epic Games account in good standing, and you must accept the Epic Account Balance Terms and Conditions available at https://www.epicgames.com/account-balance-terms. The currency of your Gift Card must match the currency of your Epic Account Balance.
A Gift Card will not be valid until it is properly purchased and activated. For a list of authorized retailers visit our FAQs located at https://www.epicgames.com/redeem. Once purchased, a Gift Card will not be reloadable. Gift Cards are not debit or credit cards, deposit accounts, or linked to a deposit account. Your Gift Card is not a bank-issued card.
Use
Gift Cards are redeemable only to your Epic Account Balance, which can only be used at participating Epic Services. By “Epic Services” we mean our websites, stores, games, applications, or other products or services we make available to you, such as Fortnite, Epic Games Store, or any of Epic’s digital storefronts.
For users under 13 years of age or their country’s age of digital consent, whichever is higher, their Epic Games account may be a “Cabined Account.” For Cabined Accounts, Epic Account Balances may be limited to purchases on Epic-owned games like Fortnite, Rocket League and Fall Guys, and a parent or guardian will need to provide consent to enable other purchases. To learn more about Cabined Accounts, visit https://www.epicgames.com/cabinedaccounts, and for instructions for parents or guardians to provide consent, please visit https://www.epicgames.com/parental-consent.
Any information we collect when you purchase or redeem a Gift Card through the Epic Services will be handled according to our privacy policy available at https://www.epicgames.com/privacypolicy.
Gift Card Balances
Any promotional Gift Card that we provide to you may expire and may be subject to additional terms and conditions associated with the promotion or offer. Non-promotional Gift Card balances do not expire, and there are no fees associated with the Gift Card.
A Gift Card can only be redeemed once for its full amount. When you redeem a Gift Card, the full amount will be associated with your Epic Account Balance and will be non-transferable.
If you are unable to redeem a Gift Card, please contact Epic’s customer service for assistance at https://www.epicgames.com/help.
Restrictions
Once you purchase or receive a Gift Card, you bear all risk of loss, including if the Gift Card is damaged, lost, stolen, or used without authorization, or any loss due to a computer or hard drive malfunction when redeeming the Gift Card. Unless otherwise required by law or permitted by these Gift Card Terms, Gift Card amounts cannot be redeemed for cash, are non-refundable, and cannot be returned, exchanged, or resold. After you redeem a Gift Card, your use of the balance may be subject to additional restrictions in the Epic Account Balance Terms and Conditions at https://www.epicgames.com/account-balance-terms.
If your Epic Account Balance and/or your Epic Games account has been terminated, you will be unable to redeem any Gift Card, and you will not be entitled to any refund except as required by applicable law.
Change in Terms
Epic may make updates to the availability or features of Gift Cards or these Gift Card Terms from time to time. Epic will notify you if Epic makes a change that materially restricts or limits your ability to redeem the Gift Cards, or if Epic makes a change to this "Change in Terms" section.
Theft or Unauthorized Use
You agree not to use your Gift Card in any manner that is unlawful, misleading, deceptive, unfair, or otherwise harmful to Epic, or another user of Epic Services. You will use Gift Cards in compliance with all applicable laws, including all sanctions, export and re-export restrictions, and regulations of the U.S. Department of Commerce and other agencies and authorities of the United States and other countries that may apply.
We reserve the right to use all remedies or countermeasures available under applicable law if we suspect any abuse or fraud in connection with Gift Cards, including blocking the use of a Gift Card, invalidating all transactions, or voiding or cancelling a Gift Card.
Disputes
Any dispute or claim arising from or relating to a Gift Card is subject to the provisions relating to binding arbitration and class action waiver (if you reside in the United States or elsewhere in the world except the European Union), governing law, disclaimer of warranties and limitation of liability and all other provisions in the Epic TOS. You agree to those provisions by entering into these Gift Card Terms or when you purchase, accept, or redeem a Gift Card.
To the maximum extent permitted by applicable law, and without limiting the disclaimers and limitation of liability in the Epic TOS, in no event will our total liability to you for all damages arising out of or related to your use or inability to use a Gift Card exceed the total amount you paid for the Gift Card. These limitations will apply to you even if the remedies fail of their essential purpose, subject to applicable law. Nothing in these Gift Card Terms will affect any statutory rights that do not allow the exclusion of certain warranties or the limitation of liability, so some of these exclusions and limitations may not fully apply to you if your local laws do not allow it.
Notices to You
If we notify you, including about changes in these Gift Card Terms, we will notify you either through your Epic Games account or through other reasonable electronic means, including by notice posted at https://www.epicgames.com/giftcardterms.
