EPIC WALLET TERMS AND CONDITIONS

These Terms and Conditions governing the use of the wallet issued by Epic Games, Inc. (“Epic Wallet”), are supplementary to Epic’s Terms of Service located at https://www.epicgames.com/site/en-US/tos (collectively, the “Terms”).  Please read the Terms carefully before you start to use your Epic Wallet or Epic Services.  In these Terms and Conditions “we”, “our”, “us” or “Epic” means Epic Games, Inc. and “you” or “your” means the registered holder of the Epic Wallet.  By “Epic Services,” we mean any of our websites, stores, games, game developer tools, applications, or other Epic products or services we make available to you. Please read this entire document to make sure you fully understand it; and, carefully review other terms potentially applicable to your use of specific Epic Services (such as Fortnite or the use of your Epic account with third-party games) before using the Epic Services.

 

You must accept and agree to abide by these Terms in order to activate, access, and use your Epic Wallet to make purchases from any Epic owned and controlled online stores that accept the Epic Wallet.  If you do not want to agree to these Terms and Conditions, you must not use the Epic Wallet.  

 

Notices

ALL CHARGES INCURRED IN CONNECTION WITH THE EPIC SERVICES AND ALL FUNDS PLACED IN THE EPIC WALLET ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART, REGARDLESS OF THE PAYMENT METHOD, EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS OR AS REQUIRED BY APPLICABLE LAW.  

 

PLEASE NOTE THAT FROM TIME TO TIME YOUR EPIC WALLET MAY BE INACCESSIBLE OR UNDER MAINTENANCE, AND AT SUCH TIMES YOU MAY NOT BE ABLE TO REVIEW YOUR EPIC WALLET BALANCE, ADD FUNDS TO YOUR EPIC WALLET, OR USE YOUR EPIC WALLET TO MAKE PURCHASES. EPIC WILL MAKE REASONABLE EFFORTS TO MINIMIZE DOWNTIME AND, WHERE POSSIBLE, PROVIDE AN ESTIMATED TIME OF RESTORATION. 

 

Restrictions

Your Epic Wallet may only be used to make purchases from Epic online stores that accept the Epic Wallet and offer goods and services in the same currency as your Epic Wallet. To access the Epic Wallet you will be asked to provide registration details, including without limitation a Payment Method (defined below) and related billing address. Epic may offer you the ability to use any Epic Wallet supported payment methods (which are set out at https://www.epicgames.com/site/wallet-faq) to place prepaid funds into your Epic Wallet (“Payment Method”). Any promotional code provided to you by Epic for use as a Payment Method may be subject to additional terms and conditions associated with the promotion, offer, or coupon. You must only use Payment Methods that you are authorized to use.  When you provide a Payment Method to Epic for use in connection with the Epic Wallet, you represent to Epic that you are the authorized user of the Payment Method, and you authorize Epic to charge (through a duly authorized service provider) your Payment Method for any funds you choose to add to the Epic Wallet together with any other fees related to those funds incurred by you. Fees or conversion charges associated with the use of certain Payment Methods by the issuer or your bank may apply. To the extent that this is allowed under applicable law, if your use of the Epic Wallet is subject to any sales or other taxes, then Epic may also charge you for those taxes.  In any event, Epic will not charge you costs exceeding the costs actually incurred by Epic. Subject to the previous paragraph, you are responsible for all uses of your Epic Wallet, including all applicable taxes and all purchases made by you or anyone else using your Epic Wallet.

 

Within any twenty-four (24) hour period, the aggregate total amount stored in your Epic Wallet may not exceed $500 USD (or its equivalent in your local currency), and the total transactions from and to your Epic Wallet may not exceed €250 per calendar month (or its equivalent in your local currency) in each case, to be determined by the currency conversion formulas posted on XE.com.  The limits in your local currency will vary as the exchange rate fluctuates.  

 

You must keep your security information (“Security Credentials”) that you use to login, access and use the Epic Wallet confidential and secure at all times and you must not share it with anyone else.

 

Epic Wallet funds do not constitute a personal property right and have no value outside the Epic Services. The Epic Wallet is not electronic money, and the use of Funds in your Wallet is limited to purchases of certain products and services offered by Epic that support the Epic Wallet.   Additionally, the Epic Wallet is not a bank account, or a payment account.  Epic Wallet funds are non-transferable, do not accrue interest, dividends, or any other earnings, are not deposits, and are not insured by the Federal Deposit Insurance Corporation or any other governmental agency or any other guarantee funds or compensation mechanism.  Unless otherwise required by law or permitted by these Terms, Epic Wallet funds are not redeemable or refundable for any sum of money, monetary value, or anything of value from Epic at any time. The Epic Wallet funds do not have an equivalent in real currency and do not act as a substitute for real currency. 

 

Unused funds added to your Epic Wallet by you do not expire. Promotional funds, such as credits or coupons may expire pursuant to the terms of such promotion. Unless stated otherwise in these Terms, once your Epic Wallet is closed, funds remaining on it may be retained by Epic, or if it is deemed unclaimed property may be reported and/or surrendered to the applicable authority, as required by applicable law.  

 

Activation

Your Epic Wallet will be activated once you add funds; and, funds will be immediately available for use following any pending or transaction periods required by your Payment Method.  No fees will be charged by Epic for the activation or use of the Epic Wallet without prejudice to other taxes and/or costs that are not paid via Epic or imposed by Epic.  You may only open, access, and use one Epic Wallet at a time, and you may not use anyone else’s Epic Wallet.  The funds held in your Epic Wallet attach to your Epic Wallet and are non-transferrable, non-exchangeable, and cannot be withdrawn. You may only use the funds in your Epic Wallet toward the purchase of eligible products, services, or features from Epic, subject to their availability, that are offered in the same currency as your Epic Wallet. Any fund balance or unused funds after each purchase will be held in your Epic Wallet. If you make a purchase request for an amount that exceeds the amount of funds in your Epic Wallet, the remainder must be paid with other available Payment Methods.  Any refund to which you are entitled on a purchase of Epic Services made with funds from your Epic Wallet will be refunded back to your Epic Wallet.  

 

The currency of your Epic Wallet is set to the currency of the first load you make to your Epic Wallet.  If you subsequently change your country of residence of your Epic Wallet, you may convert the remaining funds in your Epic Wallet to the currency of your new country of residence.  You can view the balance in your Epic Wallet and all transactions made from it at https://www.epicgames.com/account/payments at any time. 

 

South Korea Resident Refund

If you are a resident of South Korea and add any fund to your Epic Wallet, you can request cancellation of the addition within seven (7) days if the added amount remains unused.  In this case, there will be no refund fee charged to you.  If any portion of the added fund has been used or if seven (7) days have passed since the addition to your Epic Wallet, we will deduct 10% of the cancelled amount as refund fee.

 

Termination

The present Terms do not include a minimum commitment period. You may request that your Epic Wallet be closed for any reason by contacting customer service at https://www.epicgames.com/customer-service. Once your Epic Wallet has been terminated, you will be unable to use any remaining funds within your Epic Wallet, and such funds will not be refunded to you in accordance with these Terms or applicable law.  Your Epic Wallet will normally be closed within one business day of you contacting us.  

 

Epic reserves the right to suspend or terminate your Epic Wallet at any time if, after investigation, Epic determines that you have misused the Epic Wallet, conducted unauthorized Epic Wallet transactions from another user’s Epic Wallet, used the Epic Wallet to conduct any fraudulent or other illegal activity, or otherwise violated these Terms or those terms and conditions relating to an Epic Service you have used or attempted to use.

 

Theft or Unauthorized Use

You agree to notify Epic immediately of any unauthorized use or theft of your Epic Wallet or any other breach of security (and to provide properly documented evidence as reasonably requested by us).  Epic will not be liable for any loss that you may incur because of someone else using your Epic Wallet, either with or without your knowledge, because of your fault. However, you will be liable for losses incurred by Epic or another party due to someone else using your Epic Wallet because of your fault. We reserve the right to correct the balance of your Epic Wallet if a clerical, billing, or accounting error has occurred. If you have questions regarding your transaction history or any correction, or if you dispute any transaction or correction that has been assessed against your Epic Wallet, please contact customer support at https://www.epicgames.com/customer-service. We will investigate and communicate the results and correct any error that we verify as soon as we finish the investigation. If no error was found, we will communicate an explanation. You should notify us of any billing error within 60 days of the date of the transaction in question.

 

Updates to these Terms

Epic may update these Terms in the event of a change in the circumstances surrounding the performance of these Terms insofar as this is necessary to adapt to developments which were not foreseeable at the time of conclusion of the contract (including changes in applicable law, case law and technical developments) and which Epic has not caused and cannot influence and the non-consideration of which would disturb the balance of the contractual relationship in a significant manner and insofar as essential provisions of the contractual relationship are not changed to you disadvantage, subject to a prior notification of such update that will be sent to you thirty (30) days before the revised Terms are implemented.  Essential provisions are those concerning the type and scope of the contractually agreed services and the term including the provisions on termination.  If you do not accept and agree to these changes, you may request us to terminate the Services without a notice period before the changes enter into force.  Your continued use of the Services thirty (30) days after the notification and posting of revised Terms means that you accept and agree to the changes.  You will be informed about these consequences, the beginning of the aforementioned notice period and your possibility to object in the notification.

Compliance with Laws

You understand and agree that the Services, including but not limited to the Epic Wallet, may not be used, accessed, downloaded, or otherwise exported, reexported, or transferred in contravention of applicable export control, economic sanctions, and import laws and regulations, including, but not limited to, the U.S. Export Administration Regulations (“EAR”) and regulations promulgated by the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”) or other export limitations of an applicable jurisdiction. You represent and warrant that you (1) are not subject to U.S. or other applicable sanctions or export restrictions and otherwise are eligible to utilize the Services under applicable laws and regulations; (2) are not located or ordinarily resident in a country or region subject to comprehensive or near-comprehensive U.S. sanctions/embargo or sanctions/embargo of another applicable jurisdiction, unless your use of the Services in such country or region is authorized by U.S. law (or such applicable jurisdiction’s law); (3) are not an official, employee, agent, or contractor of, or directly or indirectly acting or purporting to act for or on behalf of, a government (including any political subdivision, agency, or instrumentality thereof or any person directly or indirectly owned or controlled by the foregoing) or political party subject to U.S. or another applicable jurisdiction’s sanctions/embargo or any other entity in a sanctioned/embargoed country or region or subject to U.S. or another applicable jurisdiction’s sanctions/embargo; and (4) will not use the Services in connection with an end-use prohibited by U.S. law or other applicable laws.

If you are resident of the Czech Republic, in case of a dispute you can approach Czech Trade Inspection Authority (more information available here).

 

Others

You agree with the use of the distance communication means and you will bear your costs incurred in this respect.
